Infant Car Seat--Height Rules??

I have forgotten what the rules are for knowing when your child has "outgrown" his infant carseat. My friend has a ds who is four weeks old and is already at 23". She has a Peg carseat with the height limitation at 26" and she's panicking! Is it something about the top of the ears at the top of the shell or something??

There should be at least an inch of plastic shell above his head; if there is less, he has outgrown it. Though at 23", she probably has a couple of months left.
