could I put my gate on the step below the top of the stairs or swinging over the stairs?

I am looking at the Kiddy Guard gate that rolls up to the side, and I am wondering if it would be safe to install it on the step below the top of my stairs. The top of the stairs is right next to a doorway, and there is a lot of molding that would make it difficult to install. I am thinking that if I put the gate down one step but up against the top step it might be okay, but I am not sure if it would be high enough then? If it's not high enough, can I have the gate swing over the stairs? There is so little room at the top of the staircase that a gate opening onto the landing would be very difficult to maneuver around. Has anyone installed theirs this way?
