Kidco Safeway Gate - locking latch problem?

My DH was installing our Kidco Safeway gate at the top of our stairs and for some reason it seems that the little safety button that is supposed to keep the gate for coming up doesn't pop out. I hope that make sense. I was wondering if we are missing something or are just clueless. :) Any ideas or suggestions would be appreciated! Thanks!

It should pop out as soon as the gate is in the locked position - it's what keeps it locked. Make sure the bolt that goes into the u-shaped holder is going all the way down so it's not blocking it from popping out. If it still doesn't work, I'd return it.
