Don't know if you remember my legal issue from last year.. I recently discovered that another member has started another issue for me to resolve. I just love having criminals for family. Who, with half a heart, incriminates and steals the identity of family?? Who? Who? Who?

At any rate, I contacted the atty of this person to rectify the situation. It can't possibly be ethical for an atty to allow a client to continue to use a name that is not legally hers.

I know the b boards are busy but if anyone with a legal background has a thought on this, I'd love to hear it.....

I am sorry this is happening to you. I would say that the person's attorney has no power to "make" the person do anything or refrain from doing anything. He or she will likely advise the client of the negative consequences of the behavior and would likely withdraw if the client asks the attorney to participate in the fraud by using the name.

Sounds like criminal fraud to me. And if the attorney is complicit, then he/she is culpable as well. I'd get a really good attorney with a mean streak.

Identity theft is a criminal offense - a felony in my state. I think you should contact the police. The person's attorney doesn't have any power to make or prevent them from doing anything - they can only advise that person that what they are doing is criminal.

Maybe with more specific facts about how the attorney is complicit in allowing this person to continue to use someone else's name would help me understand what you are asking.

I'm sorry - I understand that the fallout from this sort of crime is very complicated and difficult.

To me the atty has been participating since he was told "___ is not your client's name". But what do I know....

Oh, and I had to LOL at "negative consequences of the behavior". Laugh so you don't cry, right? I'm guessing criminals don't think about consequences--not this one at least.
