I'm sorry. Honestly I can't think of any court-ordered punishment that would really be appropriate for such a horrible loss. At least this part is over - I don't know if that's any consolation or not, but I hope it can be.

Sorry for your family Bill but I had reservations on if he would serve any jail time. Once I read that drugs/alochol /speed was not a factor and he was within the travel lane I kind of suspected he would get fined.

Hope your family can heal

So sorry, Bill. Do you know if he was on his cell phone or texting while driving? I'm just curious, as it just seems odd that in the middle of the day while in his own lane, he struck your niece.

My prayers go out to your family. I can't imagine the loss you guys feel.

what I still can't wrap my mind around is this....

Mom and Dad are with Ins. Co. A - Mr. Cool is excluded from their policy because of his poor driving record. Common - happens all the time. Yet they knowingly allow him to use their vehicle.

Mr. Cool is insured with Co. B - however his vehicle must not be operable so he's using mom and dad's car - that he's excluded on.

Now I read the State drops the "driving uninsured" charge because he has insurance with Co. B.

The problem with all of this is BOTH Co. A & B have denied any liability for this accident. Co. A because he was "excluded" as a driver. But Co. B is also denying liability - because he was provided with a vehicle for regular use by mom & dad (never mind he was EXCLUDED). They claim they will not extend liability to vehicles provided for use on a regular basis.

So how can the State drop the driving uninsured charges when neither insurer tied directly to this claim has accepted liability?

I know MY car insurance company told me I'd be insured (by them) on ANY vehicle I drive. My mom's, my boss's, the neighbors', a rental, etc. Is there any way to go back to insurance company B to make sure they aren't really liable?

Usually that's only if you are borrowing a car or using it for a short period of time. Becasue this boy used this vehicle all the time ( I am guessing) and it was his main transportation his insurance coverage will not cover him and either would the parent's.

I would guess it depends on how long he has been using his Dad's vehicle. Can you go after the parents? I might want to call your state insurance regulator and ask them if any company would be liable. I had to do this when I had a accident and my insurance was causing me problems.

I knew the parents were not really punished, but I figured that things would be much harsher for the driver. So sorry. :(

I'm sure Bill could explain more, but in case he doesn't want to, there was an article posted a few weeks ago about how they already went after the parents. I can't remember the actual verdict guilty/not guilty but the parents had either no or little punishment as well. :(

I'm so sorry, Bill. There truly is no price that can cover the loss of a life, especially such a young and promising one, but this really does seem egregious.

I am so sorry for your family! Not only for the death of your niece but for the continual injustice you all endured within the legal system.

This ruling is such a travesty and it sends the wrong message not only to irresponsible adults but to our children as well! It is really shameful.

I'm so sorry for your family.... I missed earlier threads about this, I guess.

While not the same, our family experienced something similar.... An 18 year old stole a car, went speeding down city streets, police chase ensued, and, in the end, he ran the stolen car into my brother-in-law's car to create a diversion. BIL was killed almost instantly, and his passenger ended up being paralysed. In the end, he was found not guilty on vehicular manslaughter--they let him plea bargain it away, despite the fact that my sister was against that because of the very nature of what happened. The guy lost a few hundred dollars in fines, a few hours in community service, and some time spent with a probation officer.... My sister lost her husband, and, worst, her kids lost their dad, 2 of them so young that they don't have memories of him.

As you already have experienced, sometimes there is no justice in our so-called justice system....

It is just a tragedy all round. It's too bad they were not willing to take the case to court, difficult or not. I wish I had words of comfort.

Lalasmom--that is a horrendous story and I am sorry for your family too.
