Does anyone own one of these trikes for your DC?

Thinking about buying one for DS's 4th birthday, but have seen several comments about an uncomfortable seat, which is making me consider other options. Anyone else have this problem with the seat?
Also, at what age / height was your DC able to start using the trike? DS will be 4 and is currently 39". Based on the reviews that I have read, I believe he will be able to ride the trike with the seat in the closest slot, but wanted to know about others' experiences.
