Thank you so much everyone, for all of the good wishes. It's not until 1, and it will likely last several hours, so no news yet. I'll let you all know though.
Th amount being disputed at this point is about $50K. Our attorney told us it would likely cost around that much if we have to go to trial, so settling makes the most sense for everyone, however this man, and I use that term loosely, does not have a reasonable bone in his body. He has come right out and told us his goal is to make us lose as much as possible, and drag this out as long as possible.
The bulk of his claim is that we should have to make up for lost rent that could have been earned during the almost 2 years that it took to sell the house-which was the vast majority of the estate. The reason it took 2 years to sell is b/c he wanted to buy us out, and kept having issue after issue securing a loan, and despite our attempts to help him (b/c we just wanted to get everything done), he would not cooperate at all. There was a clause put in the trust that we could not sell for 1 year unless everyone agreed, so our hands were tied.
Meanwhile, as the year came to a close, he moved into the house without permission, and refused to let any agents come in. We had to evict him, and that process is lengthy (and expensive). He ripped things apart that we then had to pay to fix. He did unauthorized repairs that we specifically told him not to b/c they would not improve the value of the house, (he is a contractor) and he made us pay for them. It was just one thing after another- believe me, we desperately wanted to sell b/c the value of the house was dropping all of this time, but we had to do things legally. So you can imagine how big of an added insult him trying to get this lost rent out of is!

Well, it looks like we've settled. We still got royally screwed, but hopefully it's over. Nothing is official until a judge signs off on it (which will be about another week).
